Yes they do. But of course they can't if you assume they won't and don't
tell them.

Have you run into sites actually hosting the download(s), Gerry, or just
sites where links to the download(s) have been posted? Big difference.

These sites are almost certain to be breaching the laws of copyright by
distibutiing copies of software contrary to the terms imposed by
Microsoft when they obtained the software. I am sure Microsoft could
stop the distribution if they wanted to.

I have no idea what's included in that download and I'm not about to find
out. If you suspect it's MS copyrighted material, you may contact
secure[AT]microsoft.com and bring it to their attention. Since it's been
available Nov-05, I suspect MS is already aware of it.
