i have had enough !!! help before i snap this radeon in half !

Yep, there are MaxPayne patches out. And also there is a known ATI 3.9
driver problem with CallOfDuty. Go here to fix:

compatible driver and your 9700 card is NOT DX9 compatible. Try an older
driver for stability.
it most certainly is a DX 9 card

load newest chipset drivers and then reload video drivers
