Is it okay under licence to rent ( and charge ) the windows xp media (CD's)
to a third party? I dont plan to sell the software but simply loan the
software out to people who have lost the original disks and need to repair
windows.

Nope. You are a pirate providing illegal copies of one license to multiple
users.
 
I should probobly expand, I have no intention of providing any activation
key, just the physical CD, still illegal?
 
Your scaring me Vanguard! Dont Hurt Me! Dont worry I have no intention of
doing anything illegal, I was simply intrested in knowing if media
distribution without a licence was deemed legal. At the end of the day the
end user would have to enter their own valid licence code to activate anyway!?

Thanks a NO then. Or is it, as the EULA applies to the user who enters their
Licence Code, buy providing the media, (not the license) does the EULA apply
to someone who provides the windows xp media disc (not the license). hummm???

I think you are talking about something that would require you to have a
volume license.

specialist to better understand what you can and cannot do with Microsoft

They should contact Microsoft directly for a replacement CD as long as
Windows XP is retail.
If their Windows is OEM, they should contact the seller.

Have you considered there are many different types of CDs with their own
Product Keys?
Also the different types are not interchangeable?
How many of the different types of CD do you have available?
You could find yourself in a bind with your customers when they find out
their key is not compatible with your CD. At that point installation may
have gone far enough to cause them problems if the procedure is stopped.
There are other potential issues even if you assume you are not violating
the EULA.

I am still wondering if some kind of license exists for distributing media,
but not selling licencing.

ask your mom for some decency because you have obviously lost the original
batch that she gave to you..
 
You have names 3 of about a dozen and you have not noted whether are Home,
Pro, Tablet, MCE, full, upgrade etc.

I am pretty sure no such license exists.
Contact Microsoft Licensing for verification.

Hello, You may want to find out if the (U.S.A.) state you reside in has any
statues, regulations etc. concerning rental issues, and if Microsoft's EULA
supercedes the states right to allow rental of the operating system cd, not
the licence just the disc.

This may be a state issue vs federal issue. Abrogation of "individual" state
rights.

Not that I agree with the implied intent of the OP, but it is
worthwhile reminding readers that it has occasionally been suggested to
people who have lost their Windows CD (but not the license) to borrow
one of the same type and use it for a reinstall/repair. If THAT is
legal, then the only question is whether or not it is legal to charge
for such a LOAN.
