That is actually an OEM copy (with all the limitations that an OEM
product has) and NOT the blue boxed retail copy they have used the
picture of.
It is perfectly within their rights to require the purchase of
hardware to accompany an OEM OS purchase in the US.

It's also not necessary according to the latest OEM license. It is necessary
that they sell an unopened one pack (or multi pack) rather than opening a
multi pack and selling individual units but the hardware is not a
requirement. Anyone doing this is probably ignorant of the OEM license and
probably selling pieces from opened multipacks. Or possibly they make a lot
of money on hardware sales :-)
