We deliver a licenced embedded xp that we built inhouse on terminal
devices to a custumer of us.
Now this customer wants to buy xp embedded labels for his own directly
from MS and wants to use our xp embedded system to save some money.
Is this legal?
What arguments can we use to stop him from using our development? Could
it be right that the Product Identification Key PID makes it illegal to
make use of our xp embedded development under alien licence labels?

Thanks, Juergen

Juergen,

I am not a lawyer but as far as I know the PID on the labels (sticks you place on the devices) must match the PID number that was
used to build the image that was deployed on those devices. PID number in the image is not only mentioned the WERUNTIME.INI file but
in the system registry as well (and actually used in the activation process).

Juergen, you'll have to apply to Microsoft to have your customer set
up as a "third party installer." However, your contract may not allow
for TPIs so you'll have to find it and re-read it. If not, it will
require you to release your old contract and sign a new one that
does. The contracts typically last a year.

Good luck.

Thanks for your answers. Your're right, it is not possible to mix
license label and image that descend from different custom license
agreements (and from that from different PIDs).
Doing so is as good as a pirate copy.
At least there should be a contract extension with microsoft called
"Third Party Installer" so the customer is allowed to makes authorized
copies of our xpe image. He then still needs our license labels...

It's important to communicate the EULA to customers so they know about
the copy prohibition.
