So it shows up as a drive, but an empty drive?

You might try data-recovery tools aimed at hard drives but those being
win32, that run from windows so the thumbdrive driver is loaded, else
possibly from a board that has bios support for one, so it's natively
supported in DOS. Offhand I have no idea which data recovery tools
might be simple enough that they'd blindly accept a thumbdrive, but
failing that I think your data is gone. It's probably not even worth
trying to recover the data, unless you can (safely) crack open the
drive's housing and examing the internals for signs of damage.

Where you carrying it around in your pocket or had subjected it to
some type of mechanical or environmental stress (like sweat or water)?

no, I put it in my bag, so, I don't think water could get into it, but yeah, all the driver loads up again, like my usb has never
been there before, the only difference is that it doesn't need the driver CD to load up the driver, then asked me if I want to
format the USB when I click on the drive.
so yeah, thx for your help anyway, I will make sure I have backup next time when I use it.
