Redundancy

Been in my job around 18 months and was put up for redundancy. Was given one months pay and asked to leave the same day as the notice. However, i had 25 days holiday remaining. Am i entitled to any sort of pay out for these? Carried 5 days over from last year to which i had planned on using this summer to do some decorating.

I can't see anything online..

Yep, I'm pretty sure you are entitled to pay for the days holiday you have left (from the year start to the date your job ended).... however, as you have been working there for 2 years the rules could be different (but I would guess not). I'd check with direct.gov.uk a they are pretty good with things like this, and guesses on here won't be up to date with the law:

Unfortunately employment law isn't my area, but I'm fairly certain that you would be entitled to receive payment in respect of holiday owed to you.

Did they tax the payment? Sounds like it's a payment in lieu of notice (PILON) rather than statutory redundancy pay. Usually an ex-gratia termination payment (ie conpensation for breach of contract rather than reward for employment services) is free from tax up to £30k, but if you have a clause in your employment contract stating that you are entitled to a PILON it may be taxable unfortunately.

As waht Becky says, but to include your statutary sic pay, which is not taxable...My adveice is get yourself a good Solicitor and get one soon..
 
Yeah, you should get paid for holidays you didn't take, as essentially you have worked those days when you were not meant to. You've worked 25 days extra and are entitled to that money.

You will probably have to just write off the 5 days you carried over.
 
Holidays run January to December so not sure if i can claim payment for those. I only used half a day though. Also, i carried over 5 days from the previous year.

Therefore i had 20 days this year and 5 days from last year.

Bex, they paid into my account my standard monthly rate this month so i'm assumining i have been taxed. Also received a letter to say they are required to pay me until 20th of March due to having to give me one months notice. Just need some advice really of what i'm entitled to in terms of holidays. Finding another job is proving to be quite hard at the minute!
