Recycle Bin - Confirm file delete popping up when disabled

When the "Display delete confirmation dialog" box is
unchecked I still get a "Confirm File Delete" notice when
I try to empty the recycle bin. Anyone know why and how to
fix?
 
I believe that checkbox is only for when you delete a file
(to move it to the recycle bin).
