even if the cd drive was not set as a boot drive and the bios was password
protected?

Nobody has the CD disabled as a boot device. It doesn't make sense to.

The BIOS normally has a password protect facility that would do this and
thus prevent anyone gaining access, even through boot disks.

the CMOS battery, replace it -- bang, BIOS password gone -- boot up
from a Knoppix CD and access the hard drive that way.
