Hi I have read the article about my rights as a consumer on this sight regarding warrenty well here is my case I purchased a motherboard 15 moths ago whch came with a manufacturers 3 warrent and is has gone duff had it tested by the shop I got it off and they agree with this now I have tried to contact asus with no reply for a week so I went back the the shop and told them that they were still liable for the board and it's warrenty with that I gave them a copy of what I found on this site then I asked for replacement board and they won't they say it is down to the manufacter and it is there I should go all well and good I said but I have been trying to get in touch with them for a week with no joy and still they refused to replace it and they told me to sue them and if I did I would pay all the costs
Now I want to know before I take this further am I in the right to ask for a replacement or not and if I do take them to the small claims court will I win and will I get all my costs back
I will be doing this out of princble the mony does not come into it just the way they have refused
You bought the good from a shop ... your 'deal' was with THAT shop not the manufacturer of the goods, you are within your rights to demand a replacement, but not a refund (you will have to claim compensation) ... however, it may just be worth your 'headache' to deal with the manufacturer direct. Yes, that has its own set of problems.
Will you get costs if you went to court? ... Probably, if you win yes.
It is standard practice among traders to honour your statutory 12 months warrantee, but when it comes to manufacturers "extended warrantees" it is better to deal with them direct. You have six years in which you can make a claim ... and there lies the rub ... "making a claim".
Some shops will send the item back to the manufacturer, on your behalf, and you will have to wait for it to be assessed before a replacement is issued, but these 'shops' are far & few. As this shop bought it off a 'supplier' and not from Asus direct is also another reason for their reluctance to 'help' you.
You have had the item more than six months, so you cannot invoke the theory that the item was 'defective' at manufacture. So I say ... deal with the manufacturer direct, eventually they should honour the warrantee.
Have a word with 'Citizen Rights' they are better poised to help you.

Dealing with the shop can take literally months and probably end up in all sorts of nastyness.
Send the board back to the manufacturer (which will also take months), but you will get it sorted without any face to face nastyness.
I sent back a microsoft mouse to microsoft after 18 months. And got a brand new replacement 2 months later. I think Asus will be quite similar in their customer service.
