Microsoft Antispyware should avoid scanning the system
restore folder or at least allow us if microsoft can or
cannot scan sytem restore folder.

Right now, as with antivirus apps, it can scan, but cannot clean. This is a
source of some confusion. If you have spyware in the system restore folder,
you should disable system restore, and then re-enable it, and establish a
new restore point asap. Ditto for viruses.
But don't take this action until your system is clean and stable except for
these threats in the system restore area. They aren't a problem unless the
restore point is used.
