Is Ad-aware Spyware

An acquaintance of mine says that in the past he has read several articles
stating that Ad-Aware is in fact spyware in itself Is there any basis for
this rumour? I feel he may have misread the wording adware and Ad-Aware.
Have you any thoughts or information on this matter?

Perhaps he's confusing Ad-aware (by Lavasoft) with Noadware (crap) or even
ad-ware itself?!

Another query however what is the situation with Lavasoft not issuing
updates currently?

The last Ad-aware Definition File Update was June 15.
I do not know of any issues with Lavasoft not releasing frequent
updates -
