how to avoid spyware like elite bar?

I see a lot of discussions about how to remove elite bar on the internet.

My question is, how to not get it in the first place? What software does it
come with? Would MS AntiSpyware real-time protection gives a warning if
elite bar tries to install?

Last but not least, isn't it illegal for software to not allow user to
uninstall it? Why isn't the maker of elite bar sued? And considering how
annoying this must be, who would buy the products it advertises in pop ups?
 
You can get it innocently by just browsing a good website or downloading
shareware or pirated software, we are all vulnerable.

MSAS maybe gives a user a warning but the problem is a never ending
"flood" with new variants.

Most important for users is to understand that nearly nothing is "for
free"..........

If a user click on something and then skips to read the EULA this users
PC
directly is filled with spyware.

Or Messenger plus, it is really easy to forget to uncheck that you dont
want to support/install
any bundled spyware during install (default installs Lop)

I think Spyware Blaster,Spyware Guard & Spybot Search &

blocking this type of crap.

If your using IE especially without service pack 2 then
it does leave some issues with vunrabilities with IE
itself.These are often closed by security patches which
come from microsoft on the updates page.
