Just bought one, model 6L120P0 and installed in my Windows XP sp2 and
it sounded like a train that has seen better days.

Since the shop won't accept returns and I can't claim on the warranty
I just dumped it in the trash bin.

Your post reads a lot like a troll...

What do you mean "shop won't accept returns"?
Unless you live in some 3rd world country with very lax
laws, the shop has no choice in the matter as their
requirement is to deliver to you the working part you paid
for. There is not policy or other aspect of choice they can
take on the matter if it didn't work originally.

If it did work originally why couldn't you claim warranty?
OEM part? Why would anyone buy OEM from a seller with
horrible attitude towards customers? Regardless, even then
you may still have laws protecting your interests.

Ya, right...

Check the RMA pages on Maxtor's website.

Sorry to disappoint you, but this is not a troll. I'm from Malaysia,
and the provisions for RMA or whatever does not apply outside of the
USA or Canada. I've already been to their website.

Yes, third world country. If I were a lawyer, I'd do something. Since
I couldn't do that I just wanted to warn others to whom this small
amount of money is not small. I wish I had read about the complaints
against Maxtor before purchasing it.

Been there, done that. Please do not assume that the circumstances
elsewhere is the same as that in the USA. You guys are lucky as far as
consumer rights are concerned. On hind sight, I realize, that I should
have mentioned that I am from a third world country. Otherwise the
whole thing doesn't make sense. My bad.

Admittedly I'm not current on Malaysian law but surely they
can't regularly conduct business like that? Where would it
end but in chaos?

Which complaints? Ever few months one brand or other has
some user all steamed up and starting a thread on a web
forum if not usenet, then as always, it turns into everyone
who had one of those fail chiming in, but that doesn't
suggest the other brands are bulletproof either.

For it to be DOA, I'd suspect something fishy, or rough
handling, not which brand it is.

Believe me, it is chaotic. Most of the dealers here are hit and run
operators. Some are good ones but they are like diamonds, hard to come
by. Actually I went to the shop with intention of buying Seagate but
the guy said he only had Maxtor and he assured me that it is good and
quiet.

True it was my own mistake to be too lazy to shop around and to be so
gullible. So, I did give myself a kick in the butt... not a really
hard one though! :-)

You're right on that point. Every brand does have some disgruntled
customers and I've come to think that luck plays a part too. My two
40gb ATA100 Seagate (3 years old) are so quiet I can really hear a pin
drop. And fast too.

Well, it wasn't exactly dead. That is the trouble. If it was dead, I
would have insisted on a refund or do something more drastic than
just walking away. When I went back to him, he said the crunching
noise is normal and conveniently forgot what he said before the sale.

Once of these days, when I have nothing better to do, I'd record the
sound, convert it to a .wav file and let you guys enjoy the Maxtor
cacophony.

BTW, I hope that Seagate won't go down the tube with the recent
merger.

If the shop has sold you faulty goods, they are legally bound to replace the
item or refund you.

Failing that, why not contact Maxtor directly. If you have a genuine Maxtor
product with a serial number, then they should honour the 3 year warranty.
