A different angle of the old distance selling etc.

I bought a new graphics card from Overclockers for my new Dell XPS. The card arrives (late as it happens thanks to Amtrak) but I can't get it to work. All my efforts just give me a blank screen - even at boot. Put the old one back in - fine (apart from the issue with my LCD monitor - causes snowing effect with ATI cards). New one - nothing. Tried everything I could but I couldn't get any response from it.

So I asked them to sort it out. They gave me a RMA and I sent it back. Next thing I know I'm being told I going to have to wait 10 days (working presumably) before they get around to look at it.

I'm not very happy about this as I need a new card now. The old one is driviing me nuts!

Do I have any options here?

Presumably, if I say I want to cancel this agreement they are going to say the product wasn't returned in a saleable condition e.g. the antistatic bag the cards come in was opened. Apart from that it's all as I received it.

My contract was for a next day delivery of this card. Shouldn't the replacement be sent out on the same terms? i.e. they have so far failed to deliver me a working card by the next day which is what I asked for?

If I wait until they decide to have a look at it and then return it to me saying there's nothing wrong with it. Can I return on the basis that it's incompatible with my Dell? Also, I presume if I wait the 10 days I will have lost my right to return it under the distant selling act?

I must admit I haven't had very good experiences with them in the past. Out of 6 orders, 4 had problems. The only reason I went back was because they are the only place to sell the BFG cards int his country.

Am I a sucker or what!

Thats what they like to think.
But it sounds like it was DOA. so they should exchange it by return, did you tell them it was DOA if not you should have.
 
Well not those words exactly but words to that effect.

I haven't had a chance to respond to their reply yet so I'll be asking them tomorrow if it's their policy to replace DOA goods immediately or not.

Why didn't I go for some other graphics card then I could have gone to my regular suppliers.

Yeah thanks. I had seen them there and I would have paid the extra cost if my local one had what I wanted. They didn't have any 6800's and they couldn't tell me when they get them in :(

Latest on Overclockers. Sales said they don't know anything about DOA or returns and gave me another no. When I finally got through they told me they have no seperate policies for DOA's. Everything regardless of how long you had and whether it ever has been working it treated the same! These guys obviously are keen for return business!
